Please read the following terms and conditions. By continuing to access the Brain Foodstore website service from this page, you (the "user") will be deemed to have accepted these terms and conditions. In particular, please note that unauthorised use or downloading of material from the website is absolutely prohibited.
1. In the compilation of the Site, every care has been taken to ensure accuracy. Where errors or omissions are brought to the attention of the Brain Foodstore (BFS), amendments will be made as speedily as possible. However, BFS does not accept any liability to any person in contract or tort or otherwise for direct or consequential loss caused to the user arising from anything contained in this site or for any error or omission in it even if such loss or damage is caused by the negligence of BFS or its servants or agents.
2. The editorial content of this Site is copyright of BFS and/or the authors, photographers and illustrators who contribute material to the Site, and the user shall not alter or remove any copyright symbol or any other identification or information concerning the authorship or ownership of any of the content of the site.
3. The user shall not copy, market, resell, distribute, retransmit, publish or otherwise transfer or commercially exploit in any form any of the content of the Site.
4. The user will not use or display the name or logo of BFS or any similar name or logo or act in any way that would imply that the user is an agent of the Brain Foodstore.
5. (a) Certain merchandise and services are available for purchase from the site ("Chargeable Services"). If the user wishes to access these, the user will pay the applicable fee in accordance with the rates and procedures specified by BFS from time to time together with any applicable value added tax or any other sales tax payable in relation thereto.
(b) In accessing any of the Chargeable Services, the user shall take all reasonable steps to protect BFS data and the BFS Service from access by unauthorised third parties and will use any password or user identification (ID) or user name issued by BFS for use in accessing the Chargeable Services. The user accepts that it is responsible for the use of any such security measures and warrants that it will keep any such password, user identification or user name or any other security mechanism or device confidential and will not disclose it to any other person.
(c) Some of the goods or services comprised in the Chargeable Services are supplied by third parties and some are supplied direct by BFS. As regards those which are supplied by third parties, BFS shall have no responsibility to the user in respect of them and gives no warranty as to satisfactory quality, merchantability, fitness for purpose or compliance with any description in relation to them. The terms implied by Section 39 of the Sale of Goods and Supply of Services Act, 1980 of Ireland are hereby excluded from these terms and conditions.
(d) BFS shall have no liability to the user whether in contract or in tort for any loss suffered by the user resulting from the use of a credit card, debit card or charge card or any modification thereof in order to access the BFS service.
6. BFS shall have no liability to any person for any injury or loss (including personal injury and consequential loss) suffered while participating in sports or leisure pursuits described or referred to in the Website. The material in the Website is given for information only and BFS gives no warranty as to the safety and security of such sports and leisure pursuits or as to the competence of those organising the said sports and leisure pursuits.
7. Clicking on certain links within this website may take the user to other sites and BFS shall have no responsibility or liability of any kind for the accuracy or content of any information or any other aspect of any such websites.
8. Due to the nature of interactive services and the Internet generally, BFS gives no warranty or commitment that the use of the Site will be free from interruptions or errors, and BFS shall have no responsibility or liability in respect of or arising out of any communication or network defects, breakdown, malfunction, error, delays or failures (whether temporary or otherwise) while using the Site.
9. These terms and conditions shall be governed by and construed in accordance with the laws of Ireland (excluding laws governing the conflict of laws) and the parties submit to the jurisdiction of the Irish courts. This will not prevent BFS from pursuing a claim for breach of contract, copyright infringement or otherwise in respect of these terms and conditions in any other jurisdiction throughout the world.
Fees
Delegates must pay all fees in advance of attendance at any BFS events, otherwise admission cannot be guaranteed
Discounts
Multiple booking discounts apply to delegates booked at the same time and from the same organisation and may not be used in conjunction with any other discount or offer. Discounts will be applied to the delegate/s with the least expensive booking.
Transfers & Substitutions
Delegates wishing to transfer bookings to other BFS events or into the name of other parties or organisation may do so solely at the discression of the BFS
A delegate who cancels his or her place less than 24 hours before the start time of an event will not be permitted to transfer the place to another event.
In the case of any transfer, where the event transferred to is more expensive than the event transferred from, the balance must be paid before the transfer is effective. There will be no refund payable where the event transferred to costs less than the event transferred from.
Cancellations/Refunds
Delegate fees paid to the BFS are non refundable except at the discretion of the BFS
Audio Recording – licence to use
Unauthorised Audio and video recordings are strictly forbideen. Individual BFS presentations may, at the discretion of the BFS be used by delegates. Copyright, ownership and intellectual property rights of individual presentations will be published on the BFS website but in the absence of notice to the contarary remain the property of the BFS
Alterations/Disclaimer
It may be necessary for The Braindfood Store to change the content and timing of the programme, the speakers, the date or the venue. In the unlikely event of the programme being cancelled by The Braindfood Store, a full refund will be made. For all bookings, the liability of The Braindfood Store shall be limited to the amount of the fee actually paid to The Braindfood Store by the delegate. The Braindfood Store shall not be liable where an event is cancelled or cannot take place due to circumstances beyond its reasonable control.
Registration Information
Registration information, including directions to the venue and timings, will be sent to the delegate by email at least 7 days prior to the event. The Braindfood Store will not be responsible for the non-arrival of registration information. Late Payment
The Braindfood Store reserves the right to charge late payment interest on any outstanding invoice at the rate of 5% above the base rate of AIB
Conference Material
The views experessed by all speakers at BFS events are the views of those individuals. They in no way reflect the view of the BFS, its shareholders, employees, agents or any other group associated with the BFS
Limitation on Liability
Except in jurisdictions where such provisions are restricted, in no event will The Brain Foodstore be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits, even if The Brain Foodstore has been advised of the possibility of such damages.
Disputes
This site is controlled and operated by BFS from its offices in Ireland. If there is any dispute about or involving the Site, by using the Site, you agree that the dispute will be governed and construed by Irish law. In the event of a dispute arising out of or relating to these terms and conditions, or your use of or access to this site, litigation must be brought in court in Ireland without regard to its conflict of law provisions.
Indemnity
You agree to indemnify and hold The Brain Foodstore, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site.
Ticket Terms and Conditions
1. Tickets are issued subject to the Rules and Regulations of the Venue.
2. Please check your tickets, as mistakes cannot always be rectified.
3. It is the responsibility of the ticket holder to ascertain the date and time of any rearranged event.
4. The management reserves the right to refuse admission and may on occasions, have to conduct security searches to ensure the safety of the patrons.
5. Every effort to admit latecomers will be made at a suitable break in the event, but admission cannot always be guaranteed.
6. We regret that tickets cannot be exchanged or refunded after purchase.
7. Tickets are sold subject to the management's right to alter or vary the programme due to events or circumstances beyond its control without being obliged to refund monies or exchange tickets.
8. If this ticket is re-sold or transferred for profit or commercial gain by anyone other than the BFS, Venue Management, it will become voidable and the holder may be refused entry to or ejected from the venue. The BFS reserves the right to cancel any tickets advertised or published in any manner with the intent to resell for profit or commercial gain.
9. The venue may operate a No Smoking Policy.
10. The unauthorised use of photographic and recording equipment is prohibited.
11. The Promoter, Venue Management accept no responsibility for any personal property.
Sponsorship
The BFS welcomes approaches from organisations who offer products or services that may be of interest to delegates at our events. Potential sponsors should note that the promotion of products or services which compete with those of BFS will not be permitted. Terms & Conditions for Exhibitors
Men in the Attic Ltd trading as The Brain Foodstore will be referred to as the conference organisers in all correspondence.
2. The ~Burlington Hotell will be referred to as conference hosts.
3. Companies and individual traders will be referred to as exhibitors.
4. The organisers reserve the right to accept or refuse admission to any exhibitor without
explanation.
5. Booking of stands: Space only stands will be provided for the exhibition and will include a
table and power outlet. Exhibitors booking stands should have their own backdrops or
suitable display system including spotlights.
6. Exhibitors must obtain sufficient insurance cover to guard against any claims arising from
their presence at the exhibition and provide evidence of this at the time of booking.
7. The hotel or conference organisers will not be liable for any loss, damage or injury however
caused, incurred or suffered to any person whilst in the hotel, conference, exhibition area or
car parks.
8. Additional power supply, electrics or other specific requirements will have to be requested
from the organisers at the time of booking.
9. Exhibitors who provide their own stand and lighting must check with the hosts regarding
suitability of lights and appliances to be used.
10. Exhibitors displaying computers and associated products must check with the hosts
regarding a balanced electrical loading in the exhibition area.
11. The organisers will accept no responsibility for power failures, venue generator changeover,
overloading due to exhibitor appliances or any electrical failure during the conference.
12. The organisers will accept no responsibility for damage or theft to exhibitors’ products at any
time from the beginning to the end of the exhibition.
13. Exhibitors must not use any form of amplification that interferes with the conference, other
exhibitors or in any way causes annoyance to the delegates or visiting public.
14. All exhibitors will have access to the exhibition area on the day before the conference and
must have their stands completed 30 minutes before opening of the exhibition.
15. All exhibitors must have their stands products, etc. removed from the venue on the last day
of the conference as stated on correspondence from the organisers.
16. Stands will not be reserved or allocated until full payment is received.
17. Stands will be allocated in the indoor exhibition on a first come first paid basis. The
conference organisers will at all times be of assistance and will offer help and support to
create a worthwhile exhibition for all exhibitors.
18. Exhibitors will only be allowed to exhibit externally in the designated areas to allow for the
circulation of local traffic in the vicinity.
19. The exhibitors cannot tamper with electrics, spotlights or other fixtures in the hotel or
surrounds.
20. Stands must be staffed at all times during the exhibition.
21. No posters, signs or banners are allowed on any walls in the exhibition area.
22. No sellotape, blue tack or any form of adhesive to be used on any walls in the hotel and due
care to be take to ensure no damage is done to any part of the hotel. Damage to any part of
the hotel or surrounds will be the responsibility of the exhibitors who caused such damage
and must be paid for by such exhibitors to the hotel.
23. Exhibitors and their staff must wear exhibitor badges at all time during the exhibition. The
conference organisers will issue these in advance.
24. On arrival please check with the conference organisers and the hotel before moving
onto your stand area.
